This seminar seeks to help in-house counsel manage the commercial and sovereign risks of an investment or project.

First, we will discuss how companies can minimize risks when entering into cross-border transactions. Strategies covered will include how to draft effective arbitration clauses,how to choose between different international arbitration rules, how to take advantage of investment treaties, and what enforcement and collection issues should be considered when entering into a contract.Second, we will consider how commercial disputes can be resolved efficiently and cost effectively. This part of the program will include a discussion on the legal and administrative strategies which in-house counsel can adopt at the first sign of a dispute, as well as provide guidance on how to decide whether to negotiate, mediate, litigate or arbitrate a dispute, and the pros and cons of each.Third, the seminar will conclude with a look at how to challenge and enforce arbitration awards in Indonesia and around the world.

The seminar will be presented by distinguished practitioners from Harvardy, Marieta & Mauren (Indonesian law firm) and Dechert LLP (international law firm), including Mark Mangan, an author of the leading book on SIAC arbitration, A Guide to the SIAC Arbitration Rules, and Dennis Hranitzky, who has led some of the most high-profile enforcement efforts around the world. We are also pleased to announce that the seminar will be moderated by leading figures of Indonesian corporate, academic and arbitration life.
