    The Definition of Visa

    Visa of the Republic of Indonesia, from this point onwards, referred to as Visa, is a written statement, either manually or electronically, granted by an authorized official to travel into Indonesian Territory and becomes the basis for granting a stay permit.[1]

    Every Foreign Citizen who enters Indonesian Territory is obligated to have a legal and valid Visa unless otherwise stated under Law 6/2011 and international agreements.[2]

    Types of Visas

    Basically, there are 4 types of visas in Indonesia that are regulated under the laws and regulations, namely diplomatic visa, service visa, visitor visa, and temporary stay visa.[3] Types of visas and their uses can be found in the following description:

    1. Diplomatic Visa

    A diplomatic visa is a type of visa granted to foreigners who hold diplomatic passports and other passports, including their family members, to enter Indonesian territory in order to carry out diplomatic duties, based on international agreements/conventions, the principle of reciprocity, and courtesy.[4]

    1. Service Visa

    A service visa is a visa granted to foreigners who hold official/service passports and other passports, including their family members, who will travel to Indonesian territory in order to carry out non-diplomatic official duties from their government or international organization.[5]

    It is important to note that the granting of diplomatic visas and service visas shall be the authority of the Minister of Foreign Affairs and their issuance shall be carried out by the foreign service officials at the Representative of the Republic of Indonesia.[6]

    1. Temporary Stay Visa

    There are two categories for the granting of temporary stay visas to foreigners:[7]

    1. spiritualists, experts, workers, researchers, students, investors, second homes, and their families, as well as Foreign Citizens who are legally married to Indonesian Citizens, who will travel to the Indonesian Territory to reside for a limited period of time; or
    2. in the framework of joining to work on ships, floating equipment, or installations operating in the archipelagic waters, the territorial sea, the continental shelf, and/or the Indonesian Exclusive Economic Zone.

    "Second-home" temporary stay visas are visas that are granted to foreigners and their families to stay in Indonesia for 5 years or 10 years after fulfilling certain requirements.[8]

    Temporary stay visas are granted for a maximum period of 5 years, 2 years, 1 year, 180 days, or 90 days.[9]

    1. Visitor Visa

    A visitor visa is a type of visa that is granted to foreigners who will travel to Indonesian territory for government visits, education, socio-cultural, tourism, pre-investment, business, family visits, journalism, or stopovers in order to continue their trips to other countries.[10]

    In addition to the abovementioned reasons, visitor visas may also be granted to citizens of certain countries, as determined under the regulation of the Minister of Law and Human Rights upon arrival at immigration checkpoints by immigration officials.[11]

    Visitor visas are divided into 3 types, specifically single entry visas, multiple entry visas, and visa on arrival (“VOA”), as described below:[12]

    1. Single Entry Visa

    This type of one-way visa is granted to foreigners to stay in Indonesia for a maximum of 60 days or 180 days,[13] for tourism, family, social, business purposes, pre-investment, art and culture, government duties, non-commercial sports, comparative studies or short courses and short trainings, conducting emergency and urgent work, giving lectures or attending seminars, continuing to travel to other countries, joining means of transportation located in the territory of Indonesia, making journalistic visits, participating in international exhibitions, attending meetings held with the head/central office or representatives in Indonesia, purchasing goods, making films, providing guidance, counselling, and training in technology application and industrial technology innovation to improve the quality and design of industrial products as well as overseas marketing cooperation for Indonesia, conducting audits, production quality control, or inspections at company branches in Indonesia, and prospective foreign workers in work capability trials.[14]

    In addition, single entry visas can also be granted to stateless foreigners and/or foreigners holding non-national passport travel documents to carry out tourism activities, family, social, business, pre-investment, arts and culture, government duties, non-commercial sports, comparative studies, short courses, and short trainings, carrying out emergency and urgent work, giving lectures or attending seminars, continuing to travel to other countries and joining means of transportation located in Indonesian territory.[15]

    1. Multiple Entry Visa

    This visa is a type of visitor visa that is granted to foreigners with a visa validity period of 5 years, to stay in Indonesia for a maximum of 60 days or 180 days,[16] and which are granted for government, pre-investment, business, and family purposes.[17]

    1. Visa on Arrival (“VOA”)

    Visa on Arrival or VOAs are granted to foreigners, citizens of other countries, governments of special administrative regions of a country, and certain entities who are subject to VOAs to stay in Indonesia for a maximum of 30 days.[18]
