Govt. Urged to Prioritize Introduction of Comprehensive AI-Governance Framework

  • The Executive Director of the Institute for Policy Research and Advocacy (Lembaga Studi dan Advokasi Masyarakat/ELSAM), Wahyudi Djafar ("Executive Director"), has issued a statement claiming that Indonesia is in urgent need of a dedicated framework that specifically addresses the utilization of artificial intelligence ("AI"). This perceived urgency is in line with a recent United Nations General Assembly Resolution recommending the establishment of safe, secure and trustworthy AI systems that are in line with principles of sustainable development.
  • In this regard, the Executive Director explained that any AI governance model that is ultimately adopted may utilize several approaches simultaneously (e.g. technology, ethics and law). While Indonesia has already established a set of guidelines that specifically address the ethics of AI utilization, as outlined under Circular of the Minister of Communication and Information Technology No. 9 of 2023 ("Circular 9/2023"), the Executive Director is urging the government to work to develop of a more legally-binding framework on the utilization of AI due to the seriousness of the various potential impacts and implications that are associated with the utilization of this new form of technology. Such a framework should, in the Executive Director’s view, extend beyond the current set of ethically related guidelines set out under Circular 9/2023. Nevertheless, the Executive Director also affirmed that the introduction of Circular 9/2023 represents a positive first step in terms of the establishment of a well-developed AI governance regime.
  • The Executive Director went on to explain that several countries have already begun to regulate the use of AI, including the European Union (EU), which has issued an AI Act that adopts a risk-based approach to AI governance that classifies AI under four categories of risk. Meanwhile, within the Southeast Asia region, the Association of Southeast Asian Nations ("ASEAN") has established its own AI governance and ethics guidelines, which will now serve as a reference for ASEAN members during the development of AI governance across individual member states.
